Late singer Hara’s mother lost her inheritance lawsuit, and the constitutional court gave their ruling on parents receiving their deceased child’s inheritance.
Hara passed away in November of 2019, and soon after, her brother filed a lawsuit against their estranged mother who was seeking Hara’s inheritance. After almost 5 years from that incident, the constitutional court ruled against family members who don’t fulfill their duties to their deceased family members to receive an inheritance.
On April 25, the constitutional court ruled unanimously on Article 112, Section 4 of the Civil Code, calling it unconstitutional. The Civil Code allows family members to gain a part of the inheritance no matter what situation. However, the court ruled the rights of siblings of the deceased to inherit anything if they did not contribute to any of the inherited property is difficult to justify.
The Constitutional Court has now ruled that Article 112, Paragraphs 1 to 3 of the Civil Code, which allows inheritance to direct parents, children, and spouses of the deceased is unconstitutional. This means family members who neglected or abused the deceased is against justice and common sense.
The ruling also means Hara’s mother will not receive any inheritance from Hara’s estate.
